Terms of Service

Plain-English summary: Momentum is a software tool that helps online coaches manage leads and follow-ups. You own your data. Don't use it for anything illegal. We can update these terms — we'll tell you when we do. This is a first-draft legal document and should be reviewed by your own attorney before you rely on it in production.

1. Who we are

Momentum is operated by MLKMEDIA LLC, a limited liability company (trading as "Momentum"). In these terms, "Momentum", "we", "us", and "our" refer to MLKMEDIA LLC. Momentum provides a software-as-a-service platform that helps online coaches track conversations, leads, and follow-ups. By creating an account or using the service, you ("you" or "Customer") agree to these Terms of Service.

2. Your account

You must be at least 18 years old and provide accurate information when signing up. You are responsible for keeping your password secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Your content and data

You retain all rights to the content you upload — including screenshots, lead information, and messages ("Customer Data"). You grant us a limited license to process Customer Data solely to operate and improve the service for you. We do not sell your data, and we do not use your Customer Data to train third-party AI models.

You are responsible for having the right to upload any content you put into Momentum, including consent from the people whose conversations you import.

4. Acceptable use

You agree not to:

  • Use Momentum for anything illegal, harassing, or deceptive.
  • Attempt to reverse engineer, resell, or white-label the platform.
  • Upload malware, scrape our systems, or overload our infrastructure.
  • Import contacts or conversations you do not have the right to store.

5. Subscriptions, billing, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, taxes, invoicing, cancellations, and refund mechanics are governed by Paddle's Buyer Terms.

Momentum is offered as a paid subscription. Fees, billing frequency, and any usage-based charges (for example, overage fees when lead volume exceeds your plan's included allowance) are shown at checkout. Subscriptions renew automatically until you cancel. You can cancel any time from your account settings; cancellations take effect at the end of the current billing period.

You may request a refund of your most recent subscription charge within 14 days of that charge. Refunds are limited to the most recent billing period only, and extra lead packs are non-refundable once any credits from the pack have been consumed. See our Refund Policy for details on how to request a refund through Paddle. We may adjust pricing with at least 30 days' notice.

6. AI features

Momentum uses third-party AI models to summarize conversations, suggest replies, and analyze leads. AI output can be inaccurate. You are responsible for reviewing any AI suggestion before sending it to a lead or client. Momentum is not liable for the content of messages you choose to send.

7. Service availability

We work hard to keep Momentum available, but we do not guarantee uninterrupted service. We may schedule maintenance, roll out updates, or temporarily suspend the service to protect it or its users.

8. Termination

You can close your account any time. We may suspend or terminate your access if you violate these terms, misuse the service, or fail to pay. On termination, we will provide a reasonable window for you to export your data before it is deleted.

9. Disclaimers

Momentum is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, that AI outputs will be accurate, or that using Momentum will produce specific business results.

10. Limitation of liability

To the maximum extent permitted by law, Momentum's total liability under these terms is capped at the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or lost clients.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll notify you by email or in the app at least 14 days before they take effect. Continued use of Momentum after the effective date means you accept the updated terms.
